Welcome to DiLMAXX. These Terms of Service (“Terms”) govern your use of our services, including website design, web application development, hosting, and any other services we provide (“Services”).
By using our Services or accepting a quotation/proposal from us, you (“Client”) agree to be bound by these Terms.

1. Services

We provide professional website design, development, and related digital services. The scope, timelines, and deliverables will be specified in a separate Agreement or Quotation accepted by the Client.

2. Payment Terms

• Advance Payment: A non-refundable advance (usually 50%) is required before we start work.

• Balance Payment: The remaining payment must be made before launching the website or handing over deliverables.

• Additional Charges: Any extra features, third-party tools, or services requested outside the agreed scope will incur additional charges.

Failure to make timely payments may result in suspension of work, removal of the website from hosting, or legal action under Sri Lankan contract law.

3. Content & Client Responsibility

• The Client is responsible for providing all necessary content (text, images, videos, logos) in a timely manner.

• The Client confirms that all provided content is lawful and does not infringe copyrights, trademarks, or other rights under Sri Lankan law.

• We are not responsible for any legal issues arising from Client-provided content.

4. Intellectual Property

• After full payment, the final website design and code will be transferred to the Client (except for third-party software, libraries, or templates used under license).

• We reserve the right to display the project in our portfolio and marketing materials.

5. Revisions & Changes

• Quotations include a fixed number of revisions, usually specified in writing.

• Major changes or additional work beyond the agreed scope will be billed at our standard hourly or project rates.

6. Hosting & Domain

• If we provide hosting, it is subject to the terms and uptime guarantees of our hosting provider.

• We are not liable for downtime, data loss, or performance issues caused by the hosting provider.

• If the Client manages their own hosting, they are responsible for security, backups, and server configuration.

7. Warranty & Support

• We provide a [60 day bug-fix warranty] after project launch for any coding errors.

• This does not include new feature requests, design changes, or issues caused by third-party interference.

• Ongoing maintenance requires a separate agreement.

8. Limitation of Liability

To the fullest extent permitted by Sri Lankan law, we are not liable for any indirect, incidental, or consequential damages, including but not limited to:

• Loss of revenue, data, or business opportunities

• Security breaches outside our control

• Issues caused by third-party plugins, themes, or hosting

Our liability is limited to the amount paid by the Client for the specific project.

9. Termination

• The Client may terminate the project before completion, but advance payments are non-refundable.

• We may terminate services if the Client breaches these Terms, engages in unlawful activities, or fails to pay agreed fees.

10. Governing Law

These Terms are governed by the laws of Sri Lanka. Any disputes will be subject to the jurisdiction of the courts of Colombo, Sri Lanka.

11. Changes to Terms

We may update these Terms from time to time. The updated version will be posted on our website with a revised effective date.
